Ah Ten had a ten year lease of land at allotments 10 and 12 in Brisbane Street at West Ipswich, which was the property of Margaret Sloane. When the lease expired, Ah Lane occupied the land but the lease had not been transferred to him.

Mrs. Sloane wanted Ah Lane to be ejected from her land and the case appeared before the Police Magistrate on 5 September 1892. Ah Lane did not want to leave but through the interpreter, Sam Young, he said he would go if he was able to have time to 'get his vegetables off the ground', which would take about four months. The Police Magistrate initially ordered that Ah Lane should leave the property within a week but the timeframe was extended to three weeks.
